Terms of Service

1. Agreement and eligibility

These Terms govern access to MerchantDeck AI. By installing, subscribing to, or using the service on behalf of a Shopify store, you confirm that you can bind that business to these Terms and that the information you provide is accurate.

2. The service

MerchantDeck AI analyzes approved Shopify catalog information and merchant instructions to produce growth audits, prioritized recommendations, specialist analysis, and quality-assurance results. Features, limits, and availability can vary by subscription plan.

During the public beta, the service is read-only. It does not automatically edit products, themes, advertisements, campaigns, emails, or other merchant systems.

3. Subscriptions, trials, and billing

Paid subscriptions are presented and billed through Shopify. The selected plan, billing interval, trial period, renewal price, and any applicable charges are shown in Shopify before approval. Subscriptions renew until canceled through the available Shopify controls. Except where required by law, charges already incurred are non-refundable.

4. Merchant responsibilities

• Maintain an authorized Shopify account and protect access to it.
• Provide lawful instructions and ensure you have rights to the data and materials processed through the service.
• Review recommendations before acting and independently verify legal, financial, advertising, product, and operational decisions.
• Comply with Shopify policies, consumer-protection rules, privacy requirements, marketing laws, and other laws applicable to your store.

5. AI output and no guaranteed results

AI-generated output can be incomplete, inaccurate, or unsuitable for a particular store. MerchantDeck AI does not guarantee revenue, conversion, ranking, advertising, deliverability, or other business outcomes. Output is operational guidance, not legal, financial, tax, medical, or other regulated professional advice.

6. Acceptable use

You must not use the service to:

• violate law, third-party rights, or Shopify policies;
• submit malicious code or attempt unauthorized access;
• circumvent plan limits, security controls, or tenant isolation;
• generate deceptive, discriminatory, infringing, or unlawful content;
• resell or reverse engineer the service without permission.

7. Ownership and feedback

You retain ownership of merchant data and materials you submit. The operator and its licensors retain ownership of MerchantDeck AI, including its software, workflows, designs, and documentation. You grant the limited rights needed to process merchant data and provide the service. Feedback can be used to improve the service without an obligation to compensate you.

8. Third-party services

MerchantDeck AI depends on Shopify and other infrastructure and AI providers. Their services are governed by their own terms and can change or become unavailable. We are not responsible for third-party products outside our reasonable control.

9. Suspension and termination

You can stop using the service and cancel through Shopify. We may suspend or terminate access for material breach, non-payment, security risk, unlawful use, or when required by Shopify or law. Following termination, data is handled according to the Privacy Policy and applicable retention obligations.

10. Disclaimers and liability

To the maximum extent permitted by law, the service is provided on an "as is" and "as available" basis without implied warranties. The operator is not liable for indirect, incidental, special, consequential, or lost-profit damages. Subject to mandatory law, aggregate liability arising from the service will not exceed the fees paid for the affected service during the three months before the event giving rise to the claim.

11. Governing law and changes

These Terms are governed by the laws of Bulgaria, without overriding mandatory rights that cannot lawfully be excluded. Disputes are subject to the competent courts there unless mandatory law requires otherwise. We may update these Terms for legal, security, or service changes. Continued use after an update takes effect means acceptance of the revised Terms.
